Customer Agreement

This agreement (the “Customer Agreement”) is between Caywood Propane Gas, Inc., a Michigan corporation (“Caywood Propane”), and  , whose authorized signature appears below (the “Customer”).

Customer hereby agrees with Caywood Propane as follows:

  1. All of the information submitted with the Credit Application and any information submitted with the Become a Customer form on the Caywood Propane website is true, accurate and complete in all material respects and contains no material omissions that, if included, would alter Caywood Propane's terms of business with Customer.
  2. All of Customer’s business with Caywood Propane is governed by Caywood Propane’s Standard Terms and Conditions, which are subject to change without notice and Customer will be bound by the Standard Terms and Conditions from time-to-time amended and in effect even if Customer has not been given prior notice of such change(s).
  3. The Standard Terms and Conditions, Credit Application and Become a Customer content and information are, subject to paragraph two of this Customer Agreement, incorporated into this Customer Agreement as if fully set forth in this Customer Agreement. Customer specifically acknowledges that it authorizes Caywood Propane to charge Customer's payment method on file for any amounts determined by Caywood Propane to be due and payable under the Standard Terms and Conditions. Customer agrees that this authorization survives termination of the customer relationship until all amounts due and owed to Caywood Propane have been paid. Customer also acknowledges that all telephone calls to and from Caywood Propane are recorded.
  4. If the Customer is a corporation, partnership or LLC, both the Customer and the individual signing below on behalf of the Customer represents, warrants and personally guarantees that: (i) he or she is duly authorized to sign  this Customer Agreement, (ii) the Customer is duly organized, validly existing and in good standing under the laws of its state of organization, (iii) the Customer is authorized to enter into this Customer Agreement and that the Customer Agreement, Standard Terms and Conditions, and any other agreements with Caywood Propane are enforceable in accordance with their terms.
  5. Customer understands that propane may be dangerous and acknowledges access to and familiarity with important safety materials available on Caywood Propane’s website at caywoodpropane.com

Customer hereby signs this Customer Agreement as of the date set forth on the first to occur of the signature dates below.

IF YOU ARE SIGNING ON BEHALF OF A CORPORATION, PARTNERSHIP OR LLC YOU MUST TYPE  YOUR PERSONAL SIGNATURE INSTEAD OF THE NAME OF THE CORPORATION, PARTNERSHIP OR  LLC WHEN THE SIGNATURE BLOCK APPEARS AFTER YOU CLICK “SIGN HERE” NEXT TO THE ARROW.
